Self Storage Laws You Need To Know About!

Today, self storage is a thriving business in the United States and all over the world. Since the 1970’s storage facilities have continued to multiply in number and expand in size. Somewhere along the way, facilities started to realize that they needed a plan of attack when tenants couldn’t, or refused, to pay up on their current or overdue rental fees. And so storage auctions were born out of a necessity for facility owners to recoup the loss of income from delinquent accounts. As with any flourishing enterprise, it wasn’t long before state legislations got involved in the action and set out to create self storage lien laws to protect both the renters and the storage facility owners.

There isn’t a definitive record available on when auctions started to occur. We know that storage facilities as a whole really started to boom in the United States in the 1960’s and 70’s, beginning with prominence in California and the West Coast and spreading like wildfire across the rest of the country in the following years. The laws and regulations shortly followed. In North Carolina for example, according to the documentation I was able to find, the laws were first written in the early 1980’s. Suffice it to say, today almost all of the 50 states have laws on the books on the subject.

The world is a much different place than it was 20+ years ago when facilities started to dot the countryside and the laws on self storage auctions were first written and passed. The internet has created a brave new world in pretty much every imaginable way. (Like this blog for example. 20 years ago I would never have been able to instantly update subscribers with information! We live in an awesome age of information. More importantly, today I don’t have to wear shoulder pads to be office appropriate. But I hear they’re making an unfortunate come back. For shame!)

However, until recently, many states were still operating under the antiquated guidelines of yesteryear, leaving many facility owners frustrated and in a jam. In 2012 the tide began to shift on the topic, and 12 states passed altered or added statutes to their laws. In 2013 the changes will continue. 10 states are currently working to update or add to their laws.

On January 22nd we posted an awesome guest blog from Jenny Zhang at Sparefoot detailing the changes in Ohio laws specifically. But what about everybody else? Aside from Ohio, changes have been implemented in Arizona, Colorado, Florida, Illinois, Kansas, Maine, Michigan, Nevada, Rhode Island, Tennessee, Texas, and on February 26th of this year, Georgia.

The new laws range from making changes to how facility owners are required to send notices (email vs the traditional newspaper announcement) to what can be done with boats and vehicles that are abandoned. For example, in Illinois the Self-Service Storage Facility Act permits operators to have vehicles and boats towed from the facility after 60 days of default in lieu of processing the titled property for sale.

In Alabama, California, Maryland, Massachusetts, New Jersey, New Mexico, Oklahoma, Oregon, and Pennsylvania new laws have been proposed as recently as this month. The propsed laws vary by state.

New Mexico legislature is proposing a shortened time frame for the lien sale from 90 days to 60 days.

In Alabama the law looks to shorten the default time and denial of access from 30 to 15 days. It would also authorize a facility owner to notify an occupant of default via first class mail or email. The admendment would delete the requirement that the notice include a description of the property and a denial of access to the property. These are just some of the amendments currently on the table in the state regarding self storage.

In California, several changes to various sections of the law are looking to be updated for these our modern times. Included in the amendments are changes to the Declaration In Opposition To The Lien Sale document. A renter is required to fill out if this form and return to the storage facility if they wish to file a lawsuit if they feel their items have been wrongfully put up for auction.
Many of the changes being proposed across the states are comparable. Some of the items I’ve already mentioned were visible in several of the amendments I read. While the language may vary state to state slightly, the general intent was very similar.
Overall the legislation is working to pass amendments that protect facility owners from lawsuits, (and headaches), to bring the requirements into the 21st Century and to make certain laws passed with vague language more specific and concise so that there is less confusion on the legalities involved with holding an auction.

However, as in California, other amendments are being put onto the table that will help protect renters and their items, and to give them a clearer guideline of what is required of them if they should fall behind in their rent.

One thing has been made abundantly clear by all these new and changing laws; storage auctions are flourishing across the country and are more popular than ever. As shows like Storage Hunters and our beloved Storage Wars beamed a spotlight onto the industry, and the economy hit a rocky patch, storage auctions became more mainstream, and the changes currently being put to a vote are necessary to help the laws keep up with the times and the popularity of auctions!

Access your unit during the daytime — Even if you rent a 24-hour unit, try to load/unload it during the daytime hours when lots of other people around. Thieves are always on the lookout for the perfect opportunity to ambush and accessing your unit at nighttime makes you that much more vulnerable.

Don't rent next to an empty storage unit — Burglars often use empty units as a way to break-in to those adjacent. If possible, try to rent a unit that is beside other occupied units. This will also increase the likelihood that there will be other persons around when you have to access your unit.

Store items in unmarked boxes — If you'll be storing your valuable holiday presents, don't use the original boxes. Seeing an iPad box or other valuable items is a red flag for thieves and this is more likely to make you a target.

Report suspicious activity — Keeping your self storage unit safe starts with you. It is your responsibility to be aware of your surroundings and take note of persons and activities that appear suspicious. Things to look for include a person who might be hanging out on the property but not accessing a unit. Bring this to the attention of the self storage facility so that they can report it to law enforcement, if necessary.

Buy reliable insurance — Review your insurance policy to see if it covers not only damage to your belongings but also theft. In some case, you might be able to use your renter's insurance policy as additional coverage. Discuss this with the self storage facility and ensure that you are properly covered in the unfortunate event that your self storage unit is burglarized.

These guidelines can assist in keeping your unit safe but you should also rent from a reputable facility with adequate security. The facility you rent from should be properly gated and well-lit. The saying “You Catch More Flies with Honey than With Vinegar” may be an old adage but it still applies in today’s self storage market!! It is all about that first impression and we only get one time to do it right! This saying applies to many different areas of our business in the self storage industry. It does not matter if you are working in Middletown New York, Wayne New Jersey, West Milford New Jersey or Toms River New Jersey customer service should be your number one priority!

Now there are many different areas of customer service and I will mention at least two very important areas. First thing that we seem to forget is we are here to provide our past, current and future customers with a service. In today’s times the human element is easily forgotten. We seem to believe that the internet, phone or computer will do our job for us while we continue to sit behind a desk and check emails or answer a phone with a one line sales pitch. Each customer has different needs and that is when we need to be able to be unique each and every time. Part of being unique with every customer is being prepared to accommodate them at the time of inquiry. How do you make sure you can provide them with that individual attention? As I said before, be prepared; make sure that you can be fair and honest. Be knowledgeable and ready to help them from what size will be more accommodating for their contents or needs, to giving advice in how to store their belongings for a short or long term stay in our self storage facility and you should be able to answer any of their questions with confidence. Always remember to make sure you treat all your self storage customers with the same honesty and respect that you would like to be treated with. Mention all the advantages that you can offer them at your self storage facility. You will have more success if you can engage yourself with your customers in an open and friendly manner by building that mutual trust. State plainly what you promise and follow through with it. If you are prepared in advance this is easily achievable with any customer.

Another very important area of customer service is maintaining your self storage facility in an organized and clean manner. Self Storage can be a 7 days a week job and that usually means that there are multiple employees working together to keep your self storage facility maintained. This can include additional office staff or even a maintenance department. Both of these departments are very important to each other. Because they are very important to each other they must have a clear understanding of what they should expect from one another or a clear open line of communication when communicating to any customer or potential customer. If one employee promises a tenant something it should always be documented and share with any other employee immediately. If we are second guessing ourselves or what the customer was told by another employee of Storage Station then the customer is also second guessing doing any business with us. Again I cannot say this enough “Be Prepared”!!!

These are just two simple concepts that are very easily looked past but can make a huge difference in your Self Storage business.

Team SmartStop Recognized By USA Cycling! USA Cycling announces US based continental teams

The United States houses 12 professional men’s cycling teams recognized by the UCI.

USA Cycling on Wednesday announced the eight teams registered as men’s continental teams in the United States as well as the four U.S.-based squads registered as UCI women’s teams for the 2013 racing season ( Exergy Twenty16, Specialized-Lululemon, Optum p/b Kelly Benefit Strategies and Team TIBCO-To the Top)

The eight teams are in addition to the two U.S.-based UCI ProTeams (BMC Racing Team and Garmin Sharp) and the two professional continental teams (UnitedHealthCare Professional Cycling Team and Team Novo Nordisk, formerly known as Team Type 1) previously announced by the UCI. This means that altogether, the United States houses 12 professional men’s cycling teams recognized by the UCI.

U.S.-based UCI continental teams for 2013 include: 5-Hour Energy, BISSELL Cycling, Bontrager Cycling Team, Hincapie Sportswear Development Team, Jamis Hagens Berman, Jelly Belly p/b Kenda, Optum p/b Kelly Benefit Strategies and Team SmartStop p/b Mountain Khakis.

In addition, three U.S.-based women’s teams are registered with the UCI for 2013: Specialized-Lululemon, Optum p/b Kelly Benefit Strategies and Team TIBCO-To the Top.

The Customer is Number One

As a property manager we have all kinds of responsibilities to ensure the store runs well. Not many customers know or pretend to know what we do on a daily basis. We try to have a list or responsibilities to do every day and we try not to get behind on our duties. Now of course we do have to also take care of our customers which have the highest priority on our list. In fact I know I would put a stop to anything else I was doing in order to take care of the customer, especially if it is a new renter. This is of course no matter what time of night it is.
A new renter of a storage unit arrived at their unit about 45 minutes before the store closed last night. They had a moving truck fully loaded with movers. The only problem was there was an orange lock on the unit, which meant that we had placed it on their unit. We do that so that no one puts their stuff in a lock when they are not supposed to. Regardless of the explanation, she was so upset. She just bought the unit and wanted to know why the store would place that on her unit, although earlier that day, I did tell her to put a lock on it before she left. It is for the safety and protection of the company and the customer that we lock up each unit that is empty before I leave for the night.
She was happy to know that the property manager was available to assist her in taking it off and that the reason why they had it on the unit was so no one could move their things into the unit accidently. She had plenty of time that night to move her belongings inside the storage space. The customer is our number one priority when it comes to our daily duties, so I am glad that we could make another customer happy.

With that being said some offices take more time than others to send in payment.

The United States houses 12 professional men’s cycling teams recognized by the UCI.

USA Cycling on Wednesday announced the eight teams registered as men’s continental teams in the United States as well as the four U.S.-based squads registered as UCI women’s teams for the 2013 racing season ( Exergy Twenty16, Specialized-Lululemon, Optum p/b Kelly Benefit Strategies and Team TIBCO-To the Top)

The eight teams are in addition to the two U.S.-based UCI ProTeams (BMC Racing Team and Garmin Sharp) and the two professional continental teams (UnitedHealthCare Professional Cycling Team and Team Novo Nordisk, formerly known as Team Type 1) previously announced by the UCI. This means that altogether, the United States houses 12 professional men’s cycling teams recognized by the UCI.

U.S.-based UCI continental teams for 2013 include: 5-Hour Energy, BISSELL Cycling, Bontrager Cycling Team, Hincapie Sportswear Development Team, Jamis Hagens Berman, Jelly Belly p/b Kenda, Optum p/b Kelly Benefit Strategies and Team SmartStop p/b Mountain Khakis.

Forum Post: Indoor Air Quality as the seasons change

Inspired by a couple days here in Milwaukee where the pollen count apparently went through the roof, I'm wondering how you handle IAQ and things such as allergens when the seasons change. Is it as simple as your regular maintenance of filters and air handling systems? Or do you have different tactics in how you handle things such as outside air when you switch from heating to cooling or vice versa?

Kenny Pratt and SpareFoot Co-host Industry Twitter Chat

AUSTIN, Texas – Aug. 23, 2011 – To celebrate the growing numbers of self-storage professionals active on Twitter, two social media mavens are joining forces to host the first ever industry Twitter chat, known as #StorChat. Twitter chats are online conversations in which relevant users gather at a specified time to discuss certain topics related to an industry or hobby. Chats are held weekly, with a new topic of discussion set each week. #StorChat will be held Wednesdays from 3-3:30 CST, starting Sept. 7.
